This privacy policy (“Privacy Policy”) describes how vConstruct, a wholly owned subsidiary of DPR Construction, A General Partnership, and its affiliates and subsidiaries (collectively, “DPR”, “Company”, “we” or “us” or “our”) collects, uses, stores, and shares your information, when: (1) you access and use our websites at www.vConstruct.com and all websites, media forms, media channels, and/or applications where this Privacy Policy is posted (“Websites” or “Sites”); (2) when you engage with our services (“Services”); (3) when you communicate and otherwise engage with us; and (4) when DPR receives from or provides your information to third parties. Depending on how you use our Sites and Services , the nature of your communications with us, or what third parties we may interact with, we may collect the following types of information from and about you:

• Third-Party Service Providers. We may share your information with authorized service providers that perform certain services on our behalf. These services may include fulfilling orders, providing customer service and marketing assistance, performing business and sales analysis, supporting the Site’s functionality, providing advertising and ad measurement services, analytics, and supporting contests, sweepstakes, surveys, and other features offered through the Sites and Services.
• Business Transfers; Bankruptcy. We may transfer your information to a successor organization in the event of a merger, acquisition, bankruptcy or other sale of all or a portion of Company’s assets, or other business transaction requiring the disclosure of your information.

We take the security of your information seriously and take all commercially reasonable steps to ensure your information is protected from loss, theft, alteration, or misuse, in alignment with applicable law and appropriate to the sensitivity of the information involved. However, please be advised that even the best security measures cannot fully eliminate all risks, and we cannot therefore guarantee complete security of your information.

We keep your information for as long as necessary in accordance with the purpose for which it was collected, our business needs, and our legal and regulatory obligations. If we dispose of your information, we will do so in a way that is secure and appropriate to the nature of the information subject to disposal.

We may use hyperlinks on our Sites that redirect you to a social network if you click on the respective link. However, when you click on a social plug-in, such as Facebook’s “Like” or Twitter’s “tweet” button, that particular social network’s plugin will be activated, and your browser will directly connect to that provider’s servers. If you do not use these buttons, none of your data will be sent to the respective social network’s plugin provider. So for example, when you click on the Facebook’s “Like” button on the Sites, Facebook will receive your IP address, the browser version and screen resolution, and the operating system of the device you have used to access the Sites. Settings regarding privacy protection can be found on the websites of these social networks and are not within our control.

We provide you the ability to exercise certain controls and choices over how we collect, use, store, and share your information. Please note that if you are a resident of California, you may have additional rights (see California Privacy Rights section below).

DPR and/or vConstruct contractually prohibits its contractors, affiliates, vendors, and suppliers from disclosing personally identifiable information received from DPR and/or vConstruct, other than in accordance with this Privacy Policy. However, third parties are under no obligation to comply with this Privacy Policy with respect to personally identifiable information that users provide directly to those third parties, or that those third parties collect for themselves. These third parties include providers of utilities, widgets, and a variety of other third-party applications accessible through the website. DPR and/or vConstruct neither owns nor controls the third-party websites and applications accessible through the website. Thus, this Privacy Policy does not apply to information provided to or gathered by the third parties that operate them. Before visiting a third party, or using a third-party application, whether by means of a link on the Website, directly through the website or otherwise, and before providing any personally identifiable information to any such third party, users should inform themselves of the privacy policies and practices (if any) of the third party responsible for that website or application, and should take those steps necessary to, in those users’ discretion, protect their privacy.

Our Sites are not intended for children under the age of 18. This includes any links to other websites that we provide for our convenience. We do not knowingly collect the information of children for any reason. If we learn that information has been collected from a user under the age of 18 through our Sites, we will take appropriate steps to delete such information. California Consumer Privacy Act (CCPA) If you are a California resident, you may have certain rights concerning your personal information collected by DPR under the California Privacy Rights Act and its implementing regulations (collectively, the “CCPA”). Definitions

• Personal information. Information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to you or your household.
• Sensitive personal information. Social security number, driver’s license number, state identification card, passport number, account log-in and password, financial account and password, debit or credit card number and access code, precise geolocation information, race, ethnic origin, religious or philosophical beliefs, union membership, the content of your mail, email or texts other than those communications with us, genetic data, biometric information, health information, and information that concerns your sex life or sexual orientation.

Notice of Sale and Sharing We do not sell or share your personal information. We also don’t sell or share the personal information or sensitive personal information of any California resident who is 16 years or younger. Notice of Use of Sensitive Personal Information We do not use your sensitive information for any other purpose other than what is permitted under the CCPA. California’s “Shine in the Light” law If you are a California resident and our customer, you have the right to request information from us once per calendar year regarding the customer information we share with third parties for the third parties’ direct marketing purposes. We will provide the requested information to you via an email response.

If you are a Nevada resident, you have the right to submit a request directing us not to make any sale of your personal information. We do not sell your personal information under Nevada law. Data Controller. The data controller for the purposes of this Privacy Policy is DPR Construction, A General Partnership. Voluntary Nature Of Processing. You are not required to provide DPR any of your personal data. Please note, however, if you choose not to provide certain personal data, certain features of DPR’s Sites may not operate appropriate. Basis for Processing Your Personal Data. DPR processes your personal data when we have a lawful basis for doing so, including:

DPR and/or vConstruct may, in its sole discretion, change this Privacy Policy from time to time. All changes to the company’s Privacy Policy will be reflected on this page and the date new versions are posted will be stated at the top of this Privacy Policy. Unless stated otherwise, our current Privacy Policy applies to all information that we have about you and your profile. You should regularly check this page for any changes to this Privacy Policy. DPR and/or vConstruct will always post new versions of the Privacy Policy on the website. However, DPR and/or vConstruct may, as determined in its discretion, decide to notify users of changes made to this Privacy Policy via email or otherwise.
